Definitions and Terms used herein:

1. The "Contest" referred to herein is the Cute Puppies Contest.
2. The Contest is run by Apricot Rocket Contests, Inc.
3. Apricot Rockert Contests, Inc. a Texas Corporation which uses the ApricotRocket.com system to operate a variety of Contests.
4. Apricot Rocket Contests, Inc. is hereinafter referred to as "Apricot Contests".
5. Apricot Contests operates numerous Contests at any point in time.
6. A Contestant is a person who has completed the Contest Entry Form for the Contest.
7. Contestant is hereinafter referred to as the or a "Contestant" or the or a "Competitor".
8. A Contest Entry consists of the Digital Content provided by the Contestant for the Contest that they have entered.
9. Digital Content includes Contestant's name, likeness, photos, video recordings, audiotapes, digital images, and the like.
10. Each Contest runs for 30 days.
11. Contestants compete by getting Voters to Vote for their Contest Entry.
12. The Contestant with the most votes at the end of the Contest wins the Prize Money Award.
13. There are two Prize Money Awards for the Contest.
14. Voters must "Validate their Votes" each time they vote.
15. Voter Validation requires that the Voter have, or create an Account with Apricot Rocket. The first time that a Voter Votes the Validation Process requires that the Voter create an Account with Apricot Rocket. Thereafter, Voters may vote without creating an account, however, each time a Voter votes they will be required to Login to their Account to Validate. While they are Logged into their Account Voters may vote for multiple different Contestants, or for the same Contestant multiple times.
16. When a Voter votes for the first time and creates an Account with Apricot Rocket the Contestant for whom the Voter votes is considered the Sponsor of that Voter.
17. When a Voter votes for a Contestant the Voter creates a Record in the Contestant's CRM.
18. Voter Records in the Contestant CRM enable the Contestant to know who voted for the Contestant.
19. Contestants may use the CRM tools to communicate to the Voters and invite or encourage Voters to vote again for the Contestant. Communication can be by email or text messaging at the option of the Contestant.
20. All Contestants receive a Free Account on the Apricot Rocket system which allows the Contestant to have a maximum of 100 Records in their CRM database. 
21. Each Voter represents one Record in the CRM database.
22. Contestants have the option to upgrade their Free Account to higher level accounts for a nominal monthly fee. Higher level accounts have progressively larger databases which enable the Contestant to have larger numbers of Voters (Records) to whom they may communicate.
23. Upgrading is an Option and is not required to participate in the Contest.
24. Contestants may decide to Upgrade to higher level accounts so that they have more Voters to whom they may communicate to vote for their Contest Entry thereby improving the probability of wining a Prize Money Award.
25. Affiliates are Members of the Apricot Rocket Affiliate Program. Affiliate Program Membership is open to anyone. There are both annual and monthly fees required to join the Affiliate Program and to maintain Membership. Contestants may elect to upgrade to become Members of the Affiliate Program. Affiliate Program Members have special rights and priviledges. To learn about Affiliate Program Membership read the "How It Works" section when you login to your Apricot Rocket account as a Contestant.
26. Voters are considered 'Sponsored Accounts' which means that we track all New Accounts and attribute sponsorship to an existing Account owner.
27. Apricot Contests and Apricot Rocket retain the right to communicate directly with any and all Accounts regarding Contests run on, or usage of, the Apricot Rocket system. Accounts that are Sponsored by a Contestant are not considered private Accounts of the Contestant. Apricot Contests and Apricot Rocket reserve the right to communicate direction with all such Accounts.
28. Apricot Contests will send messages to all Voters about how to become Contestants in one or more of the Contests that are run on the Apricot Rocket system by Apricot Contests. Contestant hereby acknowledges that such communications will occur and agrees that such communications are permitted under these Terms and Conditions.
29. The Contestant Entry Display Sequence is determined by the Total Vote Count. The more votes a Contest Entry has the higher the ranking in the Entry Display Sequence.

Eligibility Requirements and Limitations:

1. Contestant must be at least 18 years old to enter the competition.
2. Contestant must be a U.S. Citizen or a Legal Resident Alien to receive any Prize Money Awards.
3. Contestant must file a completed and signed IRS Form W9 with Apricot Rocket, Inc. to receive any Prize Money Awards.
4. Contestant must provide any requested documentation to certify the above citizenship or legal residency qualifications.
5. Contestant may not use any form of 'click farm' to generate votes. If Apricot Contests determine a pattern or other indication of illegitimate voting activity your entry will be disqualified.
6. Contestant may only participate in one (1) Contest at a time.
7. If a Contestant wins Prize Money from a Contest then that Contestant may not participate in that specific Contest again.

Aditional Terms and Conditions (Please Read Carefully):

1. Unacceptable Content: It is not permitted to upload any video, image, file, or other digital content which is pornographic, sexually explicit, overtly promoting any illegal activity, or which could be considered hateful. All content will be reviewed and Apricot Contests reserves the unilateral right, without challenge, to remove any content submitted by any Contestant. Any Contestant submitting such content may be banned from future use of the Apricot Rocket System.
2. Contestant Profile Page: All Accounts receive a Public Profile Page. Contestants receive a special version of the Public Profile Page customized for the Contest. This is called the Contestant Profile Page. Public and Contestant Profile Pages have a URL designted as https://crm.apricotrocket.com/username. Contestants should share that URL with their friends and ask their friends to visit that page and vote for the Contestant's Contest Entry.
3. RKTT Tokens: When a Voter votes for the first time they must Validate their Vote. When a Voter Validates their vote the first time the Voter earns 1,000 RKTT Tokens and gets an Account with Apricot Rocket. When a Voter Validates their Vote the first time the Contestant earns 100 RKTT Tokens. RKTT Tokens may be awarded by a Contestant to a Voter to encourage that the Voter votes for the Contestant's Contest Entry.
4. Affiliate Program: If a Contestant elects to Join the Affiliate Program then the Contestant, as an Affiliate, may elect to redeem RKTT Tokens for Cash from Apricot Rocket. The Redemption Rate is $1.00 for 1,000 RKTT Tokens. Affiliates also enjoy the benefits of earning a commission on purchases made by Accounts that they Sponsor. To learn details about commissions please read the "How It Works" section of the Affiliate Program from the Control Panel after logging into your Apricot Rocket Account.
5. Photography and Publicity Release: Contestant agrees that Apricot Contests has permission to use Contestant's name, likeness, photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of the Contest. Contestant agrees that Apricot Contests has and will have complete richt to use such Digital Content for any purpose.  Contestant agrees that any such recordings may be used and reused in whole or in part for publication, broadcast, cablecast, multimedia production, internet distribution, illustrations, bulletins, exhibitions, vieotapes, reprints, reproductions, advertisements, and any promotional or educational materials in any medium now known or later developed.  I acknowledge that I will not receive any compensation, etc. for the use of such pictures, etc., and hereby release EG Pitch Competition and its agents and assigns from any and all claims that arise out of, or are in any way connected with, such use.
6. Hold Harmless: All Contestants, advertisers, sponsors, judges, and event support assume the entire responsibiility and liability for losses, damages, and claims arising from their participation in the competition activities and will indemnify, defend and hold harmless  Apricot Contests and their respective agents, servants and employees from any and all such losses, damages, and claims. Apricot Contests is not responsible or liable for any loss, damage, or claims arising out of injury or damage to contestant displays, equipment, or other property used during the Contest or for the Digital Content entered into a Contest.
7. Claims: Contestant agrees to not under any circumstances file any claim or litigation against Apricot Contests or any judge, sponsor, voter, or other Competitor associated with this event based on my participation in this competition, and, if for any reason Contestant is involved in any litigation against  Apricot Contests or any judge, sponsor, or other Contest participant in this competition event Contestant agrees that no compensatory damages will be sought or allowable. The courts of Collin County, Texas rule as to jurisdiction in the event of any litigation related to this event to which Contestant might become a party regardless of how Contestant became a party to such litigation.
8. Agreement: Contestant agrees to be bound by and to abide by these Terms and Conditions, and all amendments hereto, as well as all decisions of Apricot Contests. In the event that any of these Terms and Conditions are questioned, or a clarification as to the meaining of the Terms and Conditions herein is requested, by a Contestant the Contestant hereby unilaterally and unequivocally agrees that any judgment or clarification made by Apricot Rocket will be final and will not be subject to legal challenge by the Contestant.
9. Changes or Additions to these Terms and Conditions: Apricot Contests reserves the right to amend, supplement, or modify these Terms and Conditions at any time in any manner deemed necessary and all such amendmens, supplements, or modifications shall have immeidate affect unless otherwise therein noted.
